Nah, Fox never had any rights to Spider Man. What happened was Marc Webb is contracted to direct the sequel to 500 Days Of Summer, which was made by Fox. He would've had to do that before Spider Man 2. So in exchange for Fox putting off the sequel to that movie, Sony agreed to put in an Xmen teaser in Spidey for free.
