Oh there are plenty of reasonable excuses you can use in court. If you are smart about it you can totally win- I can even give you some good legal pointers as to what direction you should have your lawyer work in. (most lawyers arent techies so you need to steer them with your defense)...
But really my point is- Why go through the hassle of having to get a lawyer and defend yourself?

No. False. The RIAA might claim that against you in an attempt to extort money, however there is a legal precedence already upheld by court that makes this an invalid legal tactic. Any lawyer worth his beans would be able to defend that lawsuit.
You are however copable for people downloading copyrighted material on your modem if you have knowledge of it and support then doing so. You are then accessory to copyright infringement and it carries the same fines as the actual infringement. However how can the RIAA prove you had knowledge of someone doing that? You dont have to prove you didnt have knowledge, the have to prove you did.
So dont put a sign outside your house saying "attention pirates. feel free to use my wifi for illegal downloads"

True. Of course I can also take my laptop to the public library with my laptop and do my downloading there...
The think about my ISP is that they usually send out written warnings to stop before any legal action is taken. Freshman year a friend of mine pirated TONS of PC games and he had to stop because they got a letter from our ISP, Cox Communications.
